Summary
An arrest is an act of government that takes away a person's liberty. The act of arrest can lead to a series of justice system acts--arraignment, trial, conviction, sentencing--that can result in longer or even permanent deprivations of property, liberty and even life. In a democratic society, such seriously invasive acts as arrests, trials and incarcerations are difficult to justify. The United States Constitution dictates that no citizen can be deprived of property, liberty or life without due process of law. Under this constitutionally mandated due process of law, agents of government must follow strict procedural guidelines in order to lawfully arrest, try and convict. The United States Supreme Court has ruled that First Amendment liberties grant the press and the public a right of access to trials. That grant becomes part of the due-process protection against secret trials. The Constitution that forbids secret trials also forbids secret arrests. The First Amendment, as documented in this research, grants the press and the public a right of access to arrest records
